Planning Appeals are determined by the Planning Inspectorate as an independent governing body, sponsored by the Department for Levelling Up, Housing and Communities.

The Appeal process allows the Planning Inspectorate to consider all material planning considerations, and from all parties. Including from the LPA, the applicant and from those who might have made representations on the application.

There is a strict timeframe for submitting an appeal to the Planning Inspectorate:

• A householder planning application – 12 weeks
• Advertisement applications – 8 weeks
• Works to Protected Trees (TPO or protected by virtue of a Conservation Area) – 4 weeks
• Any other type of Planning Application – 6 Months
• Appeal against an Enforcement Notice – before the notice becomes effective as stated on the notice

An Appeal to the Planning Inspectorate should be treated as a last resort. The reasons for a refused planning application can found in the decision notice and discussions with the Planning Officer may help to resolve these issues.
